If you drive car with no emission control anywhere in the US, that will be illegal and you will be criminally charged. But if you sell cars (a lot of them) with no emission control knowingly, you will get fined but you are not prosecuted at criminal court.
That is what US government is doing. They will fine VW a lot but there will be nobody going to jail. Do you think it is right? That was what government did back in 2007-2008 when the mortgage crisis took place. Nobody went to jail.
Politicians always say they support small business, but they never do. They alway protect big businesses.
