Does Illegal Overstay in Japan Have a Statute of Limitations?

Some people may believe that if a foreign national remains illegally in Japan long enough, the violation will eventually expire. That is not the case.

 

In Japan, unlawful overstay is considered a continuing offense. As long as the individual remains in the country without valid immigration status, the violation continues. Whether the person has overstayed for one year, ten years, or even longer, the passage of time does not automatically make the stay legal.

 

If discovered, the individual may still face deportation proceedings and criminal penalties.

 

However, Japan does have a system called Special Permission to Stay. It may be granted in exceptional cases involving circumstances such as marriage to a Japanese citizen, Japanese children, long-term residence, good conduct, and strong ties to the community.

 

This should not be confused with a statute of limitations. It is a discretionary decision made after considering the person’s individual circumstances.

 

Simply stated, time alone does not legalize an unlawful stay in Japan.
